Rationale: This resolution is to grant the administration the authority to enter into the subject contract as per the attached emergency declaration issued by the Superintendent on March 15, 2018.
While bids are not required under an emergency declaration, request for bids were issued to four known vendors on April 27, 2018. Bids were opened in public and read aloud on May 16, 2018. Only one bid was received; from American Petroleum Equipment & Construction Co., Inc. Their bid was examined and all due diligence was observed in determining that American Petroleum Equipment & Construction Co., Inc. is a responsive and responsible bidder with recent successful completion of a District capital project.
The work was designed by Fuller & D’Angelo, PC (F&D) who provided a letter of recommendation to award.

The project scope of work includes but is not limited to removal and replacement of existing 15,000-gallon, 34-year old, deteriorated underground oil storage tank with a new 10,000-gallon tank, connecting piping, fuel pump and site restoration.
Construction is anticipated to commence on or about August 1, 2018 with work continuing through October. During the school year all work will be done after school hours.

Resolution: Ladies and Gentlemen:

WHEREAS: the underground fuel oil storage tank at School 17 failed to pass the annual pressure tests mandated by Westchester County Dept. of Health, and
WHEREAS: it is required that tanks failing such tests be removed (and replaced) within 6 months of the failure, and
WHEREAS: such time constraints preclude the use of standard design, bid, build required under GML103, and
WHEREAS and emergency declaration was issued by the Superintendent of schools on or about March 15, 2018, and
WHEREAS: in compliance with General Municipal Law RFB6289 was issued to four known vendors on April 27, 2018 and opened on May 16, 2018, for CIP10830 ”Underground Fuel Oil Storage Tank Replacement” at School 17, and

WHEREAS: such bids were duly examined and as a result of this examination of the bids submitted, the administration has determined that American Petroleum Equipment & Construction Co., Inc. is the lowest responsive bidder with a bid in the amount of $493,758.00, and

NOW THEREFORE BE IT RESOLVED: that Bid No. 6289, CIP10830 “Underground Oil Storage Tank Replacement” at School 17 be awarded to American Petroleum Equipment & Construction Co., Inc., 63 Orange Avenue, Walden, NY 12586 in the amount of $493,758.00 and a term of 365 calendar days.
