Rationale:
|
A change order is a written agreement between the District and its contractor to change a building construction contract. They add to, delete from, or otherwise alter the work and/or progress schedule in the contract bid documents. CO’s are caused by any of three situations that can arise on a project: unforeseen conditions, design errors and omissions and owner directed extra work. This Change Order consists of COP-2-A, B, C & D and is required for owner directed extra work. Item COP-2-A, B & C is a result of reassigning the general construction work for the replacement of the Boiler & HVAC systems which was to be performed by the GC Contractor (Contract 1) to be performed by the HVAC Contractor (Contract 2). After notice to proceeds were issued to all 4 contracts for CIP 10816 the General Construction contractor requested to be released from the bid and declined in performing the work. Due to a late recommendation of award and not being able to man the required resources to complete the general construction work, the remaining 2nd low bidder had to decline the work. To avoid delay change orders from the HVAC, Plumbing and Electrical contractors for postponing work to the summer of 2020 and risking a breakdown of the old boilers during this coming heating season, School Facilities Management recommended the HVAC contractor perform only the general construction Contract 1 work necessary for the completion the HVAC contract work. These items of work is in the amount of 154,746 and included demolish of boiler systems under abatement, remove concrete pads, trenching, cutting & patching, painting and asbestos abatement of floor penetrations. Item COP-D is a result of the Engineer and School Facilities Management recommendations for changing the boiler design from all gas to dual fuel oil & gas capability. The change was recommended upon receiving a design revision from Con-Edison after bids & contract awards, requiring a gas booster be provided and concerns for not getting gas at the site in time for the heating season. The high efficiency boilers will run primarily on gas and on oil in the event the building heating load cannot be met, or there is shortage, or no gas and or failure of the gas booster pump. This item of work is in the amount of $47,247.00. The total value of all extra work is in the amount of $201,993.00 less the contract contingency of $75,000.00 a balance change order of $126,993 is required. FOCUS POPULATION: The stakeholders of the School 9. ASSESSMENT PROCESS: Engineer, Construction Manager and School Facilities Management will be inspecting the contractor’s work and monitoring the construction schedule through on-site inspections, daily progress meetings and record keeping.

Ladies and Gentlemen: WHEREAS by Resolution Board Item No. 21.4 at the Board of Trustees stated meeting on March 20, 2019, contract No. 2019-00000762 was recommended for award to Mengler Mechanical, Inc., 1689 Route 22, Brewster, NY 10509 and, WHEREAS: in the course of executing the contracted work it was determined that additional work is required to be performed to complete the project in the amount of $126,993.00, increasing the overall cost of the contract from $987,000.00 to $1,113,993.00. NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to issue Change Order 1 to contract No. 2018-00000762, HVAC WORK, Contract 2, CIP10816 “Boiler System Replacement and Asbestos Abatement” at School 9 to Mengler Mechanical, Inc. for the amount of $126,993.00; increasing the contract amount from $987,000.00 to $1,113,993.00.
