Rationale: This resolution is to grant the administration the authority to enter into the subject contract as per the attached emergency declaration issued by the Superintendent on October 29, 2019.
The first phase of the project that was to contain the spill, preliminary investigation to determine the source of the release, and initial waste disposal was done by Luzon Oil Company, Inc. The cost for the remediation phase is $ 36,596.93

The second phase of the project is to remove and replace the existing failed tank.
While bids are not required under an emergency declaration, however Request for Quotation for the second phase was publicly advertised on November 4, 2019, and read aloud on November 15, 2019. Only one Quote was received for an amount of $240,689.00. The Quote was examined and all due diligence was observed in accepting the proposal.
Luzon Oil Company in the past has successfully completed District capital projects. The work was designed by Eisenbach & Ruhnke Engineering, P.C who provided a letter of recommendation to award.
The project scope of work in the second phase includes but is not limited to removal and replacement of existing 10,000-gallon, 51-year old, deteriorated underground oil storage tank with a new 10,000-gallon tank, connecting piping, fuel pump set and site restoration.

Construction is anticipated to commence on or about February 17 with work continuing through April. During the school year all work will be done after school hours.

Resolution: Ladies and Gentlemen;
WHEREAS: An Emergency Declaration was issued on October 29, 2019 for the “Emergency Removal and Replacement of the Heating Oil Tank” at Roosevelt High School, and
WHEREAS: Under this emergency declaration the District solicited Luzon Oil Company, Inc to contain the spill and perform immediate remediation work, and
WHEREAS: the second phase of the work was send out for quotes, and Luzon Oil Company, Inc was the sole bidder,and
WHEREAS: the District has a substantial successful history with Luzon Oil Company, Inc., and
WHEREAS: such time constraints preclude the use of standard design, bid, build required under GML103, and
WHEREAS: Such Quote was duly examined and as a result of this examination of the quote submitted, the administration has determined that Luzon Oil Company, Inc., proposal is acceptable at a bid amount of $240,689.00, and
NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to award contract for CIP10883, “ Emergency Removal and Replacement of the Heating Oil Tank” at Roosevelt High School be awarded to Luzon Oil Company, Inc., P.O Box 1070, Woodridge NJ, 12789 in the amount of $277,285.63 and a term of 365 calendar days.
