Rationale:
|
Bids for the subject RFB were opened on June 29, 2018 at 2:00 pm. There were 8 bidders. One bidder, Triple A Solutions was determined to be non-responsive since they did not bid on all items. E.A. Morse submitted two separate bids, one per the specifications and one with a proposed “or-equals” for Item 1 Dispensers. The alternate product did not have the same features as the specified product (front loading, ADA compliance) and was not accepted.
On or about May 1, 2018 school districts in NYS were informed of the following change to Public Health Law (unfunded mandate) that would take effect on July 1, 2018:
“Section 1. Title 6 of article 2 of the public health law, as added by chapter 342 of the laws of 2014, is amended by adding a new section 267 to read as follows:
§ 267. Feminine hygiene products in schools.
Since YPS is a Pre-K through 8 District these products will be made available in all 175 student use female toilet rooms in the district. The rate of consumption is uncertain. It is anticipated that this program will cost $125,000 to $200,000 annually for maintenance of the program. Initial start-up costs are $35,000 not including the cost of labor for the installation of dispensers. |

|
Ladies and Gentlemen:
WHEREAS: the District is required to comply with the recent amendment to the NYS Public Health Law wherein all elementary and secondary public schools in the state serving students in any grade from grade six through grade twelve shall provide feminine hygiene products in the restrooms of such school building or buildings at no charge to students, and
WHEREAS: in that regard Request for Bids 6303 was issued and bids were recievd in June 29, 2018 for the procurement of dispensers and related products in compliance with General Municipal Law 103, and
WHEREAS: eight bids were opened, only six of which were viable, and
WHEREAS: the lowest responsive and responsible bidder was determined to be E.A. Morse & Co. Inc. with a bid of $37,474.10.
NOW THEREFORE BE IT RESOLVED: that the Award of General Fund Purchase Order for RFB6303 Procurement of Hospeco Feminine Hygiene Products be made to E.A. Morse & Co. Inc. 11-25 Harding Street, PO Box 728, Middletown NY 10940 in an amount not to exceed of $37,474.10. |
