Rationale: A change order is a written agreement between the District and its contractor to change a building construction contract. Change orders add to, delete from, or otherwise alter the work and/or progress schedule set forth in the contract documents at the time that the construction contract was bid. Change orders are caused by any of three situations that can arise on a construction project. They are: unforeseen conditions, errors and omissions on the part of the designer and owner directed extra work.

This Change Order is needed to identify a credit change order to a Not to Exceed Time & Material Contract in the amount of $550,000 which was awarded under an Emergency Declaration for taking over the original General Construction contract awarded to Sigma Builders Group. All general construction work was completed by Piazza in the amount of $479,569.98, leaving a balance in the amount of $70,430.02 to be credit back to YPS.

Resolution: Ladies and Gentlemen:

WHEREAS: by Resolution Item No. 14.5 dated September 17, 20145 a Time & Material contract in the amount of $550,000 was recommended for award to Piazza, Inc., for the General Construction takeover work, under an Emergency Declaration, for the “Ventilation & Air Conditioning Systems and Emergency Utilities” at the Yonkers Middle High School, CIP10229; and

WHEREAS: Piazza, Inc. completed the General Construction work for a total amount of $479,569.98; and

WHEREAS: a CREDIT is to be taken for the remaining balance in the amount of $70,430.02;

NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to issue a Change Order #1 for a CREDIT in the amount of $70,430.02 to Piazza, Inc., 3 West Stevens Avenue, Hawthorne, NY for General Construction Work for Project No. 10229, “Ventilation & Air Conditioning Systems and Emergency Utilities” at the Yonkers Middle High School” at Yonkers Middle High School, revising the original contract (611033) in the amount of $550,000.00 to $479,569.98.
