Subject: 16.9 CHANGE ORDER 2 TO AN EXISTING CAPITAL FUND CONSTRUCION CONTRACT to Talt Electric, PO617073, CIP10458 “Upgrades to Electrical and HVAC Systems” DODSON SCHOOL in the amount of $11,480, increasing the contract amount from $932,272 to $943,752 and extending the term to October 31, 2017.

Rationale: A change order is a written agreement between the District and its contractor to change a building construction contract. Change orders add to, delete from, or otherwise alter the work and/or progress schedule set forth in the contract documents at the time that the construction contract was bid. Change orders are caused by any of three situations that can arise on a construction project. They are: unforeseen conditions, errors and omissions on the part of the designer and owner directed extra work.

Work under this change order is a result of owner directed extra work.

This is supplemental to the work as listed in Change Order 2 which accommodated added security per the City’s direction wherein it was determined that all new security component installs will be compatible to their systems and follow design standards established by the City and the now shared consultant, Acenes, LLC (March 2016 Stated Meeting). The capital project was already underway when it was decided that District and COY would benefit from making the system compatible.

Unfortunately, the added and/or changed materials and changes in the design scope post bid delayed the installation of these features beyond the original bid dates and into the school year. Talt Electrical was required to complete their work on a second, premium time shift. This added $15,180.00 in labor to the original CO1. However it is offset by a credit of $3,700.00 for HVAC and electrical supply equipment not installed in the server closets. The total cost of this CO2 is $11,480.00.

Original Contract Amount: $873,000, Change Order 1: $59,272, revised contract amount: $932,272. Change Order 2: $11,480.00, revised final contract amount: $943,752.00. Term to be extended to November 30, 2017 for paperwork and payment. The contingency amount for this contract was $50,000 which was principally spent on other upgrades to the security system: “lights on” feature for the intrusion alarm - $21,000, door management alarms for the perimeter doors and added card readers for $25,960.

Resolution: Ladies and Gentlemen:

WHEREAS: by Resolution Item No. 16.8 dated December 16, 2015 a contract was recommended for award to Talt Electric., for the Upgrades to Electrical and HVAC Systems at Robert C. Dodson School, Project No. 10458, and

WHEREAS: by Resolution Item No. 17.2 dated September 21, 2016 Change Order No. 1 in the amount of $59,272 increased their contract from $873,000 to $932,272 and extended their term to March 31, 2017, and

WHEREAS: in the course of executing contracted work it was determined that additional capacities were required of the contracted security system improvements to meet newer City standards, and

WHEREAS: these upgrades were designed, specified and presented to Talt for inclusion in their contract for a negotiated lump sum of $11,480, and

NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to issue a Change Order #2 in the amount of $11,480 to Talt Inc., 410 Fifth Avenue, New Rochelle, NY 10801 revising the contract in the amount of $932,272 to $943.752 and extending the term to November 30, 2017 for paperwork and payment.
