Rationale: This resolution approves a $174,187.00 settlement with Zurich American Insurance for property damage at School 5 (118 Lockwood Ave, Yonkers) caused by frozen pipes during a severe cold snap on December 23 and 26, 2024.

Resolution: WHEREAS, On December 23, 2024 & December 26, 2024, frozen pipes caused water damages to several classrooms and the auditorium of School 5, 118 Lockwood Avenue, Yonkers; and

WHEREAS, The District evaluated the value of the damages and negotiated the sum of $174,187.00, to restore the building; and

WHEREAS, DISTRICT filed claim #5630116631 with the named insured Zurich America Insurance Company; and

WHEREAS, certain of DISTRICT’s property located at 118 Lockwood Avenue in Yonkers NY (the “PROPERTY”) was damaged as a result of the frozen pipes which occurred on December 23, 2024 & December 26, 2024, (the “LOSS”); and

WHEREAS, a Settlement Agreement has been negotiated and reviewed by the School District’s insurance brokers and by the School District and requires approval by the Yonkers Board of Education; and

WHEREAS, the Board of Education has had an opportunity to review the terms of the Settlement Agreement and finds the terms are fair, reasonable, and appropriate under the circumstances; and

NOW THEREFORE BE IT RESOLVED, that the Board of Education hereby approves the settlement of this matter in the amount of $174,187.00 and approves the Settlement Agreement made between the Superintendent of Schools and the Zurich America Insurance Company; and

BE IT FURTHER RESOLVED, that the Superintendent of Schools and those under his direction take all steps necessary to effectuate the Settlement Agreement made between the Superintendent of Schools and Zurich America Insurance Company.
