Rationale: To approve a Stipulation of Settlement resolving the Notice of Charges brought under Education Law § 3020a against Employee #42935
Funding:
Resolution: WHEREAS, a disciplinary proceeding commenced against Employee #42935,
upon Notice of Charges dated November 18, 2019 which were subsequently amended by disciplinary charges dated February 25, 2020, both preferred by Dr. Edwin M. Quezada, Superintendent of Schools, pursuant to Education Law Section 3020a; and,

WHEREAS, the Board of Education, at its meeting on November 20, 2019, found probable cause for the Notice of Charges preferred against Employee #42935; and,

WHEREAS, the Board of Education, at its meeting on February 26, 2020, found probable cause for the Amended Notice of Charges preferred against Employee #42935; and,

WHEREAS, the Notice of Charges dated November 18, 2019 which were subsequently amended by disciplinary charges dated February 25, 2020 shall both be collectively referred to herein as “Notice of Charges”; and,

WHEREAS, Employee #42935 was represented by counsel who submitted a response denying the specifications in the Notice of Charges; and,

WHEREAS, a Stipulation of Settlement has been negotiated between the Superintendent of Schools and Employee #42935, subject to approval by the Board of Education, which Stipulation of Settlement sets forth the terms of settlement of the Notice of Charges; and,

WHEREAS, the Board of Education has had an opportunity to review the terms of the Stipulation of Settlement, and finds that the terms are fair, reasonable and appropriate under the circumstances; and,


NOW, THEREFORE, BE IT RESOLVED, that the Board of Education hereby approves the Stipulation of Settlement, as negotiated and made between the Superintendent of Schools and Employee #42935; and,

BE IT FURTHER RESOLVED, that the Superintendent of Schools and those under his direction take all steps necessary to effectuate and implement the Stipulation of Settlement, made between the Superintendent of Schools and Employee #42935.
