Rationale: To approve Stipulations of Settlement resolving claims brought by employee A.S., and the Notice of Charges brought under Education Law § 3020a against Employee A.S., tenured teacher, I.D. 42751.
Funding:
Resolution: WHEREAS, a disciplinary proceeding commenced against A.S. (employee ID# 42751) upon Notice of Charges dated December 19, 2017, preferred by Dr. Edwin M. Quezada, Superintendent of Schools, pursuant to Education Law Section 3020a; and

WHEREAS, the Board of Education, at its meeting on December 20, 2017, found probable cause for the Notice of Charges preferred against A.S. (employee ID# 42751); and

WHEREAS, A.S. (employee ID# 42751) was represented by counsel who submitted a response denying the specifications in the Notice of Charges; and

WHEREAS, a Stipulation of Settlement has been negotiated and entered into between the Superintendent of Schools and A.S. (employee ID# 42751), dated August 31, 2018, subject to approval by the Board of Education, which Stipulation of Settlement sets forth the terms of settlement of the Notice of Charges; and

WHEREAS, a stipulation of settlement has been negotiated settling claims brought by employee A.S. in federal district court, and


WHEREAS, the Board of Education has had an opportunity to review the terms of the Stipulations of Settlement, and finds that the terms are fair, reasonable and appropriate under the circumstances;

NOW, THEREFORE, BE IT RESOLVED, that the Board of Education hereby approves the Stipulation of Settlement, dated August 31, 2018, made between the Superintendent of Schools and A.S. (employee ID# 42751) and the Stipulation of Settlement made in the separate claim brought by employee A.S.; and

BE IT FURTHER RESOLVED, that the Superintendent of Schools and those under his direction take all steps necessary to effectuate the Stipulation of Settlement, dated August 31, 2018, made between the Superintendent of Schools and A.S. (employee ID# 42751, and the separate Stipulation of Settlement of claims by A.S. in federal district court).
