Rationale:
|
This contract was awarded to Hudson Valley Fire Protection, Inc., 136 Washington St., Peekskill, NY 10566 under NYS General Municipal Law 103 via Board Resolutions 22.18 on June 19, 2018. The contract specifications provide for annual extension by the mutual consent of both parties under the same terms and conditions of the original contract for up to two additional years. This is hereby being extended for the second time.
This is to comply with the fire code and NFPA requirements that all kitchen hoods and fire suppression system are inspected, tested and certified operational for use annually.
The subject contract has provisions to allow for 2 annual renewals with the mutual consent of both parties and with no changes permitted in the original terms and conditions. Amendment 4 is to authorize the administration to execute the second and final renewal.
This work will be let for bid next year.

Ladies and Gentlemen:
WHEREAS: via Resolution Item 22.18 on June 19, 2018 the Board approved the award of the general fund annual service contact “Maintenance and Repair of Fire Suppression Systems”, Contract #2019-00000103, to Hudson Valley Fire Protection, Inc., for $57,175.00 and 365 calendar days, and
WHEREAS: via Resolution 22.23 on June 19, 2019 the approved the first amendment to renew said contract under the same terms and conditions for the amount $57,175.00 and 365 calendar days, revising the overall contract amount to $114,350.00 and a term of 730 calendar days, and
WHEREAS: the subject contract has provisions to allow for 2 annual renewals with the mutual consent of both parties and with no changes permitted in the original terms and conditions, and
WHEREAS: both parties consent and desire to renew this contract under said provision for the second and final time increasing the total contract amount to $171,525.00 and the term to 1,095 calendar days.
NOW THEREFORE BE IT RESOLVED: That via this Resolution the Board approves the second amendment to “Maintenance and Repair of Fire Suppression Systems”, Contract #2019-00000103, with Hudson Valley Fire Protection, Inc., for $57,175.00 and 365 calendar days. This increases the contract amount from $114,350.00 to $171,525.00 and the term to 1,095 days.
