Rationale: This resolution is to assign Architectural/Engineering Task for CIP 10922 “Fuel Oil Tank Restoration” at Martin Luther King Jr. Academy under requirements contract 619182 to Eisenbach & Ruhnke Engineering, P.C., (E&R) for $26,000.00 and 365 calendar days.

In winter of 2021 a small oil leak was discovered under the indoor 10,000 gallon indoor fuel oil storage tank. The leak was found to be at the bottom of the tank which required: emptying of the tank, filing with the NYSDEC & WCDOH and the installation of a temporary tank.

The existing tank was cleaned thoroughly and the interior was inspected. Since the tank failure, several visits were scheduled with E&R and oil tank professionals to investigate the possible causes and remedies. To restore the 10-year old tank that was built in place, E&R has been engaged to create bid documents for restoration and improvements.

This restoration of the existing fuel tank is work in place and includes but is not limited to continuous welding of all interior seams, coating the interior, testing, providing a 10-year warranty and additional work as specified to restore tank to full function.

This RFP was issued to E&R, already engaged in other design work at MLK and the most knowledgeable consultant with respect to oil storage tank issues.

E&R’s base proposal is for $24,000.00 (plus $2,000 reimbursable) to provide: field inspections of the tank; confirm existing conditions and using this information to create bid documents for the restoration of the tank. Job will be submitted to the SED for building aid evaluation. They will also be providing construction administration, testing of the interior welding and coating.

This project cost is currently anticipated to be roughly $200,000.00 and construction is planned for the fall of 2021.

Resolution: Ladies and Gentlemen:

WHEREAS: under Resolution 15.15 dated February 26, 2020, the Board of Education authorized the award contract 619182 for environmental engineering to Eisenbach & Ruhnke, Engineering PC, amount not to exceed $1 million, and

WHEREAS: by Resolution 17.5 dated May 19, 2021 the Board of Education authorized an amendment to increase the contract by $500,000.00 to $1,500,000.00 extending the term for another 365 calendar days, and

WHEREAS: work as defined under that contract is required for engineering consulting services for the capital project 10922 “Fuel Oil Tank Restoration” at Martin Luther King Jr. Academy, and

WHEREAS: the response by Eisenbach & Ruhnke Engineering, P.C., (E&R) was deemed most advantageous to the District at a cost not to exceed $26,000.00 including $2,000 in reimbursables.

NOW THEREFORE BE IT RESOLVED: That the Superintendent of Schools is hereby authorized to assign Eisenbach & Ruhnke Engineering, P.C., 291 Genesee Street, Utica, NY 13501 to the task of providing professional engineering consulting services for CIP 10922 “Fuel Oil Tank Restoration” at Martin Luther King Jr. Academy under contract 619182 in an amount not to exceed $26,000.00. Term is for 365 calendar days.
